Cadastral Survey Act 2002
The Cadastral Survey Act was enacted in 2002 by the Labour lead Government. The Act was significant as it is the last attempt by a New Zealand government to deregulate a profession. How the deregulation was done was by the removal of the term "Registered Surveyor" and the associated requirements for a surveyors education and technical competences required in order to be allowed to approve plans.
In practice, it has been recognised that a surveyor needs to meet a certain level of competence, and so the old system of registration has continued in an almost identical fashion since the passing of the Act in 2002. The only change being the total lack of Government involvement in the survey profession, the results of which will only be seen in the future.
The purpose of the Cadastral Survey Act 2002 is
3 Purpose
The purpose of this Act is—
(a) to promote and maintain the accuracy of the cadastre by—
(i) requiring cadastral surveys to be done by, or under the direction of, licensed cadastral surveyors; and
(ii) requiring cadastral surveyors to meet standards of competence to be licensed; and
(iii) providing for the setting of standards for cadastral surveys and cadastral survey data; and
(b) to provide, either on an optional or mandatory basis, for the electronic lodging and processing of cadastral surveys; and
(c) to provide for a national geodetic system and a national survey control system to be maintained.
This means the Act is to promote and maintain the system of recording all properties boundaries in New Zealand. This is done by requiring surveyors to be of a certain level of competence in order to become licensed. This Act also introduced the platform for the computer registration of property boundaries known as Landonline.
The Cadastral Surveyors Licensing Board was created by the Act.
