Land Use Consent

Land Use consent is required when land is being used in such a way that a district or regional plan requires consent for a specific activity. The use of the air, water, coastal marine area and the subdivision of land are excluded from the need for land use consent instead requiring Discharge permit, Coastal permit or Subdivision consent instead.

To clarify, to use the land is as follows:

(a) Any use, erection, reconstruction, placement, alteration, extension, removal, or demolition of any structure or part of any structure in, on, under, or over the land; or

(b) Any excavation, drilling, tunnelling, or other disturbance of the land; or

(c) Any destruction of, damage to, or disturbance of, the habitats of plants or animals in, on, or under the land; or

(d) Any deposit of any substance in, on, or under the land; or

(e) Any entry on to, or passing across, the surface of water in any lake or river; or

(f) Any other use of land—

Under the resource management Act, Land means the surface of water in any lake or river, but not the bed of the lake or river.

Some examples of Land Use consents are:

  • Planting trees on farm land in the Queenstown Lakes District

  • Building a pontoon that floats on a lake, but is not fixed to the bed of the lake

  • Building a house that encroaches into the side yards
